1) Report of Severe Beatings and Arrests in West Papua
Press Release by Paniai Traditional Council Chairman

  Four schoolboys were subjected to severe beatings, shootings and torture in West Papua, according to a report by the chairman of the
Paniai Traditional Council. The names of the four are Yulianus Yeimo (17 years old), Apinus Gobal (16), Simon Degia (17) and Apinus You
(18), along with another person whose name is Sadai Yeiumo. These incidents which occurred on  8 December 2014 are quite clearly gross
violations of Basic Human Rights.

  At the same time, another eighteen persons were severely injured: Yulianos Tobai (33),  Andarias Dogopia (34) Jermias Kayama (48),
Marice Yogi (52), Yulianus Mote (25), Agust Degei (28), as well others who were slightly injured: Oni Yeimo, Yulian Mote, Octavianus Gobay,
Noak Gobai, Akulian Gegwei, Bernadus Bunai, Neles Gobai, Jerry Gobai, Oktavianus Gobai, Selpi Dogopia and Yuniana Edoway.

  All these acts of violence  perpetrated against Papuan people are in clear violation of Law 39/1999 on Basic Human Rights and there
should be a follow-up in accordance with the stipulations in Law 20/2000 on Human Rights Courts.

  According to investigations carried out by  the Solidarity Team as well as by the National Human Rights Commission of the Republic of
Indonesia in Jakarta, it is clear that the shootings were perpetrated by members of the TNI (Indonesian Army) and Polri (Indonesian Police
Force).

  The army units involved included the following: Koramil (Regional Military Command) East Paniai, Tim Khusus (Special Team) of the
Infantry Battalion (Yonif) 753/Arga ViraTama Nabire, the Special Forces Nabire, the Special Forces of the Air Forces, and Brimob
(Special Police Force), as well as Kopassus and personnel of the
Police force  in Paniai.

  All these actions comply with the provisions  in that they were grave violations of human rights as specified in  Law 39/1999 on Human
Rights. These are: Firstly, the Right to Life which are non-derogable rights as guaranteed in Article 28 A and Article 28 of the 1945
Constitution, as well as Law 39/1999 on Human Rights and Article 6 para (1) No 12, 2005 on the Indonesia's Ratification of the
International Covenant on Civil and Political Rights.   Secondly, the Right not to be Subjected to acts of brutality,
inhumanity, and the undermining of human dignity.   Based on all the information above, the fact is that  acts of
brutality, inhumanity, and the undermining of human dignity  have been committed by the security forces. as provided for in Article 28 G para
(2) of the Indonesian Constitution, as well as Law 5/1998 on the Ratification of The Convention Against Torture, Law 39/1999 on Human
rights, Article 7,, Law 12/2005 on the Ratification of the International Covenant of Civil and Political Rights.

  Thirdly, the Rights to Feel Secure.
 Generally speaking, these events have spread fear anxiety within he community because of what people have been experiencing.

   Fourthly, Children's Rights. According to our investigations there have been violations of children's rights  as guaranteed in Article 28
B of the Constitution of Indonesia and Law 23/2002 on the Protection of Children, article 10 jo Article 37 of Presidential Decree 36/1999.
on the Convention on the Rights of Children.

  On the basis of all this that is stated above, during a plenary session of the National Human Rights Commission held on 6-8 May 2015,
the Commission set up an Ad Hoc  Team for Paniai consisting of members of the National Human Rights Commission and civilians  as provided for
in Article 18, para 2  of Law 28/2000 on Human Rights Courts, in order to carry out a thorough and comprehensive investigation.

  Last week, in accordance with an instruction  of the Ministry of Law, the Commander of the National Police Force and the Papua Police
there was a meeting in Enarotali to hear evidence from those who witnessed  the events on 7-8 December 2014, but without the presence
of the Institute  for the Protection of Witnesses and Victims (LPSK) and the National  Human Rights Commission (KomnasHam RI), despite the
fact that many witnesses had submitted a request to the LPSK.

  We therefore  call upon:

1. The Chief of Police and the Military Commander,as well as the head of the Regional Police to halt the investigations  so as to act
co-operatively with regard to the incidents of beatings that occurred in Paniai, with the presence of witnesses and members of the security
forces to be questioned by an ad hoc team on the Paniai Incident.

2. Urge the LSM Kontras,  LBH, GKI-Papua, the  international human rights organisations such as Amnesty International and Human Rights
Watch as well as the United Nations, to immediately call upon the Chief of Police  and the Military Commander to halt the investigations
currently being undertaken  without the presence of the LPSK and furthermore to write to President Jokowi urging that there be an end
to such bloody incidents such  as occurred in Paniai.

A Papua New Guinea MP says there’s no reason for West Papuan refugees to fear for their safety after the country ratified an extradition treaty with Indonesia.
The attorney general, Ano Pala, says the treaty is important as criminals have been using the porous border between the two countries for smuggling and other illegal activities.
However, some MPs warned that Indonesia might use the treaty to target some of the thousands of refugees from West Papua.
One of those MPs is former attorney general Kerenga Kua, but he says parliament agreed to add a mechanism to protect them.
“Those provisions have been written into the treaty to exclude the application of the treaty to people who are seeking political asylum in Papua New Guinea and to make it clear that the treaty only applies to criminals who have broken the laws of one country and are escaping into the other.”

Washington. A leading US senator has proposed that the United States provide hundreds of millions of dollars to help train and equip the armed forces of Southeast Asian countries faced with Chinese territorial challenges, including Indonesia.

Republican Senator John McCain, chairman of the Senate Armed Services Committee, made the proposal in an amendment to the 2016 US Defense Authorization Act expected to be passed later this year, titled the South China Sea Initiative.

It allows for the provision of up to $425 million over five years to countries including Indonesia, Malaysia, the Philippines, Thailand and Vietnam for “equipment, supplies, training and small-scale military construction.”

The amendment was approved by the Armed Services Committee on May 14 by a vote of 22 to four — indicating strong bipartisan support. It still needs to be approved by the full Senate and the House of Representatives, which will vote on the overall bill later in the year.

McCain’s proposal comes at a time of heightened tension in the South China Sea, where China has been increasingly assertive in pushing its claims to territory contested with several Southeast Asia states.

On Friday, the United States said China had placed mobile artillery systems on a reclaimed island in the South China Sea, a development that McCain called “disturbing and escalatory.”

McCain, who was taken prisoner during the Vietnam War and held for five and a half year, told a news conference in Ho Chi Minh City the United States needed to “take certain measures which will be a disincentive to China to continue these kinds of activities.”

Washington has expressed concern about the scale and scope of Chinese land reclamation in the South China Sea. It says Chinese dredging work has added some 2,000 acres to five outposts in the resource-rich Spratly islands, including 1,500 acres this year alone.

The United States has deployed more military resources to the Asia-Pacific as part of a strategic rebalance to the region and has been working to strengthen the defense capabilities of countries there and to encourage a more unified approach to dealing with China.

Some members of the 10-nation Association of Southeast Asian Nations, including US ally the Philippines and fellow claimant Vietnam, have been vocal critics of Chinese actions in the South China Sea, but the group as a whole has been divided on the issue and reluctant to intervene.

It appears to be business as usual this week for Indonesian government officials intent on maintaining the decades-long restrictions on foreign media access to the far eastern provinces of Papua and West Papua.

Just two weeks after President Joko Widodo signaled a shift in the long-standing policy, chief security minister Tedjo Edhy Purdijatno told reporters on Tuesday that a team including military and police would continue to tightly monitor foreign journalists who report from Papua. Tedjo defended the snooping by asserting that, “We aren’t spying on them [the journalists]. We’re simply monitoring their activities.”

That same day, Defense Minister Ryamizard Ryacudu said that if access to Papua was granted to journalists it came with an obligation to produce “good reports.” He didn’t precisely define “good reports,” but he explicitly equated foreign journalists’ negative Papua reporting with “sedition.”

Ryamizard’s solution for foreign media whose reporting displeases the government? “We can easily expel them,” he said.

Tedjo and Ryamizard’s comments are more than repugnant expressions of contempt for media freedom. They blatantly undermine Joko’s May 10 announcement of an immediate revocation of restrictions on foreign media access to Papua. That was a much-anticipated change Joko signaled in his election campaign last June when he stated during a stop in Papua that the government “has nothing to hide” there.

Joko’s initiative was aimed at removing the official obstacles that have long prevented foreign media who manage to get permission to enter Papua from freely reporting. The government rarely approves requests to visit or delays processing them, hampering efforts by journalists and NGOs to report on breaking events. Journalists are invariably shadowed by official minders who control their movements or make it difficult to interview people privately and without fear of consequences.

The government has long justified those controls as a necessary security precaution due to the ongoing conflict with the Free Papua Organization (OPM), a small and poorly organized independence movement. The government also consistently arrests and jails Papuan protesters for peacefully advocating independence or other political change.

Joko’s initiative to allow foreign media to freely report from Papua indicates that he sees media freedom as part of the solution to Papua’s toxic combination of political repression and impunity. The willful ignorance or outright hostility of key ministers such as Tedjo and Ryamizard will doom that plan unless Joko addresses their obstructionism head-on.

The president should start by issuing an explicit written directive spelling out Papua’s new media freedoms and the obligations of government officials and security forces to respect it. Until he does so, media freedom in Papua will continue to be held hostage by those who prefer Papua’s truths remain hidden rather than reported.

Jayapura, Jubi / Antara – Papua Police chief Inspector General of Police Yotje Mende accused rebels from the Yambi group of being behind the shooting of six civilians in Mulia, Puncak Jaya, on Tuesday (26/5) at around 23:00.

“It was the Yambi armed group which is also known as Tenggang Mati,” Mende said in Jayapura this week.

He said the attack was beyond the limits of humanity so the police and the military will conduct a search to catch the perpetrators.
“For the time being, there is no need to send reinforcements because security forces will back Papua Police Mobile Brigade,” he added.
Yambi armed groups fired the civilians home in Usir village, Mulia. And it was allegedly carried out by five people who carried firearms of various types. As a result, six people were shot, one of them died instantly. The fifth victim of gunshot wounds, three of which are now being treated in public hospital in Dok 2, Jayapura.

The incident took place at the back of the office building at Kampung Baru Kodim Pagaleme, Mulia, Puncak Jaya.

Jayapura, Jubi – Paniai Regional Customary Council Chief John Gobay denied reports that two Indonesian soldiers have been taken hostage.

“It’s not true. No hostages in Paniai. Do not exaggerate it to divert attention from the Paniai case,” Gobay said this week, in Jayapura.

Local residents in Enarotali and Komopa said two soldiers from the Komopa Sub-district Military Command, identified as Second Sergeant Lery and Second Cadet Sholeh, had been held hostage.

But Gobay said the the two soldiers took a speedboat but between the Eka and Aga rivers, they were warned by residents that the OPM headquarters was at the end of the river. “So both of them were asked to save themselves instead of being taken hostage. They jumped from the boat and spent the night at the swamp,” Gobay explained to Jubi.

Then, the Military Special Forces and Special Forces team from Sub-district Miltiary Command have rescued them. “Both soldiers were rescued by joint special forces. Other team members took the speedboat. they’re all safe. That’s all the information I knew,” he said.

Human Rights Watch (HRW) deputy Asia director Phelim Kine has said President Joko “Jokowi” Widodo should issue an explicit written directive spelling out Papua’s new media freedoms and the obligations of government officials and security forces to respect it, otherwise he could not turn his vision into reality.
He made his comments in response to recent statements by two of Jokowi’s Cabinet ministers, Coordinating Political, Legal and Security Affairs Minister Tedjo Edhy Purdijatno and Defense Minister Ryamizard Ryacudu, which contradicted the President’s promise to lift restrictions on foreign journalists covering Papua.
“The willful ignorance or outright hostility of key ministers such as Purdijatno and Ryacudu will doom that plan unless President Jokowi addresses their obstructionism head-on,” Kine said in a statement on Thursday.
The rights activist said that on May 26, or just two weeks after Jokowi signaled a shift in Indonesia’s long-standing policy on media freedom in Papua, Tedjo told reporters that a team including Indonesian Military and National Police personnel would continue to tightly monitor foreign journalists who reported from Papua.

A Papuan separatist group, the United Liberation Movement for West Papua, or KNPB, says as many as 30 of its members were arrested on Thursday by Indonesian security officials.
The group has been pushing for freedom of expression for West Papuans and is seeking international backing for the KNPB to join the Pacific sub-regional political body, the Melanesian Spearhead Group.
The KNPB says up to 32 activists were arrested as they staged a protest in Jayapura.
It is the third time this month that large numbers have been taken into custody during rallies.

    Police arrested at least 71 members of the pro-independence West Papua National Committee (KNPB) during two peaceful rallies on Thursday in Wamena of Jayawijaya district and Jayapura, the provincial capital of Papua.
“Forty-six activists were arrested in Jayapura. Five of them suffered serious injuries after being hit by police when they were giving speeches at the entrance to the University of Cendrawasih,” Victor Yeimo, chairman of KNPB, told ucanews.com.
“One was hit in the head by a rubber bullet,” he added.
In Wamena, 25 activists were arrested as they were about to start their rally, he added.
The rallies were to show support for the application by the United Liberation Movement for West Papua (ULMWP) to join the Melanesian Spearhead Group (MSG).
The MSG is an intergovernmental organization comprising the states of Papua New Guinea, Solomon Islands, Fiji and Vanuatu, as well as the Kanak Socialist National Liberation Front, a political party from New Caledonia

Asked about the alleged heavy-handed approach used by police to make the arrests, he said past acts of violence meant that police had to be careful.

Poengky Indarti, executive director of the Jakarta-based watchdog Indonesian Human Rights Monitor (Imparsial), said the situation in Papua has become more sensitive since the ULMWP’s application to join MSG.

A French journalist who was jailed in West Papua last year for not having the correct entry permit says he doubts Indonesia will follow through with its promise to lift the region's media ban.
Thomas Dandois, along his colleague Valentine Bourrat, was jailed for two-and-a-half months last year while in the province filming a documentary on the Papuan separatist movement.
"I think it will not change dramatically overnight," he told Radio Australia.
"The reports won't please the Indonesian government. There will be things they do not want to hear."
Since Mr Widodo's announcement, a senior Indonesian official said that foreign journalists would still have to apply for permits and would be subjected to screening.
"Is West Papua definitely opened to journalists, will they be able to do their job? We don't know it yet and we must stay extremely careful about it," Mr Dandois said.
Mr Dandois has returned to France but still closely follows events in the resource rich area.
"I have the feeling that if I request a visa, I will not get it," he said.
"That was the first idea that came to my mind when I heard the news. I thought, well, let's see how they will react if I ask for one."
Mr Dandois had already been in prison in Niger before his arrest in Indonesia.
The father of two had vowed "not to go back into a war zone, not to take that risk."
But the possibility of the ban being lifted has made him think again.
"We did not have enough for a full report. But it could be interesting, today ... or a year and a half later, to complete our report by interviewing both parties," he said.

The police in Papua have yet to identify those responsible for the shooting of a pro-independence leader in Nabire on Tuesday, but they detected a threat on migrants following the incident.

Tension escalated in Nabire following’s Leo’s death. Two other OPM leaders, Puron Wenda and Enden Wanimbo, voiced opposition to the Indonesian Military (TNI) and the police and threatened all migrants in the province.
Commenting on the threat, Patrige said it was nothing new and that the police were ready to respond to any situation and keep local residents, including migrants, safe.

“Therefore, we are using a persuasive approach with rebels. To help alleviate fear among local residents and migrants, the Mulia Police chief met with residents to create a feeling of security among them,” he said as quoted by kompas.com. (rms)
