Canberra
For anybody who might be in Canberra on the 28 Nov. Linda Thorpe’s Genocide Bill will come to a vote in the Senate.
Genocide Bill
What is the Genocide Bill?
All victims and survivors of Genocide should be able to seek justice through legal systems that adhere to international standards and are free from political interference.
No politician should get to say who can and can’t be held accountable to crime in our legal system, especially for something as heinous as Genocide.
But right now in this country, the Attorney-General has unchecked power to block prosecution of genocide, war crimes, and crimes against humanity from proceeding in our courts. This power is called the AG’s fiat.
This is completely against the intention of the UN’s Genocide Convention, which is based on our shared responsibility to prevent the very worst of humanity.
That’s why I introduced a Private Senators Bill to strip the Attorney-General of this unjust and dangerous veto power to parliament, the Criminal Code Amendment (Genocide, Crimes Against Humanity and War Crimes) Bill 2024.
The Bill would prevent political interference in this process and also mean that governments can be held accountable for their own actions - both here and overseas.
You can read more on the background and purpose of the Bill here.
In short, my Bill would:
- Remove the requirement for the Attorney-General to consent to atrocity crime cases. This means anyone can file for proceedings on these crimes in a court.
- Allow cases blocked by previous Attorneys-General since 2002 to be reviewed.
On Thursday 28 November My Genocide Bill will come to a vote in the Senate, and we’re planning a protest action on the day.
If you can, join us in Canberra on November 28 at 9.00am in the Senate Galleries to watch the Bill being debated or from 10.00am outside on the lawns for our protest action

Background
On the 1st December we commemorate West Papuan National Flag day or National day.
The 1st December this year is the 63rd anniversary of the first official flying of the Morning Star flag in 1961, in the then Dutch colony of Netherlands New Guinea.
The Dutch were finally about to give the West Papuan people their freedom. However, it is one of the great tragedies that at their moment of freedom it was cruelly crushed and West Papua was basically handed over to Indonesia in 1963 by the international community. A betrayal of a whole people.
Sixty-three years later, the West Papuan people are still struggling for their right to self-determination.
And the human rights abuses continue today.
The situation in the territory continues to deteriorate. There are ongoing clashes between the security forces and the OPM (the Free Papua Movement).
West Papuans continue to be arrested, intimated and killed by the security forces. A number of military operations have taken place in the past few years. During these operations house are burned, livestock killed, leaving local people traumatised and in fear for the lives.
These military operations have created large numbers of internal refugees. Human rights monitor in a recent report said ther are more than 79,000 IDPs in West Papua because of the ongoing conflict between the TPNPB and the security forces
