Sentani, Jubi – Ondofolo and khoselo (tribal chiefs) of Nendali Village, East Sentani District wanted to push for the topic of loss of customary rights in Papua to become a strategic issue discussed in the VI Congress of Indigenous Peoples of the Archipelago (KMAN).

This was conveyed by Nendali’s ondofolo Yanpiet Ebha Wally and khoselo Rukhu Neai Walinea in Nendali Village on Sunday, September 18, 2022.

“We indigenous people are always disadvantaged. Our customary rights are lost for development purposes. Indigenous people are never respected, and our dignity is trampled on. About 320 hectares of land are used by the government and the private sector without any compensation to indigenous peoples as customary rights owners,” Ebha Wally explained.

According to him, the KMAN VI was the right opportunity to convey to the government the land rights of indigenous peoples that had been ignored.

“The transfer of customary rights is tantamount to eliminating the existence of indigenous peoples. Where should we indigenous people stand if our lands were taken?” said Ebha Wally.

On the other hand, one of the khoselos of Enabhu tribe in Nendali, Erick Wally, said that land as part of mother earth had always been the pride of indigenous peoples who had existed long before the state.

“We ask all parties to respect and recognize our existence,” said Erick.

Similar sentiments were heard from the Namblong District in the Grime Nawa Valley. Chair of the Namblong Tribal Council Matheus Sawa reported that the acts of land grabbing experienced by the Namblong indigenous people also need attention from all parties, and need to be discussed at the KMAN VI as well.

“There are thousands of hectares of our land that have been claimed by investors for the benefit of oil palm plantations,” said Matheus. (*)

2) Autopsy says two Mimika murder victims shot, two stabbed
Investigation Into Mimika Murder - News Desk
19 September 2022

Jayapura, Jubi – The Mimika Police has released the autopsy results of four bodies of the Mimika murder, saying that two victims were shot and two others were stabbed. However, lawyer of the victims’ families Gustaf R Kawer believes that all four victims were shot.

“Mimika Police read out the autopsies at the grave site on Jalan Trans Mimika Poumako. According to them, Arnold Lokbere and Irian Nirigi were shot, while Atis Tini and Leman Nirigi were stabbed,” Kawer told Jubi in Mimika Regency’s capital of Timika on Saturday, September 17, 2022.

The murder and mutilation of four civilians from Nduga Regency occurred in Settlement Unit 1, Mimika Baru District, Mimika on August 22, 2022. The XVII/Cenderawasih Military Police has named six soldiers of the Raider/20 Ima Jaya Keramo Infantry Brigade as suspects in the case, namely Maj. HF, Capt. DK, Chief Pvt. PR, First Pvt. RAS, First Pvt. PC and First Pvt. R.

Meanwhile, the Papua Police named four civilians as suspects in the same case, namely APL aka Jeck, DU, R and RMH. The last name is still on the run.

Kawer assessed that the autopsy results read out by the police on Friday were different from the findings of the families who examined the bodies of the victims. When examining the bodies of the victims on September 2, the family found more wounds suspected of being gunshot wounds on the victims’ bodies and thighs.

“On September 1, the police conducted an autopsy. The next day we saw at the hospital on the body of each victim there were stab wounds, and cuts in the abdomen. Then there was more than one gunshot wound on the victim’s thigh. There was also more than one gunshot wound that we saw on almost all the victims,” Kawer said.

Although the police have read out the autopsy results, Kawer emphasized that his party was still asking the police to look for other body parts as he believed that Leman Nirigi and Atis Tini also died from being shot.

“Let us see if it is true that the two victims were only stabbed and died, or were they also shot and then mutilated? In order to do that, other body parts must be found. It could be that Leman Nirigi and Atis Tini were also shot in the head, or shot in the leg, or in the hand that has not yet been found,” Kawer said.

Further, Kawer questioned the police’s incoherent method of naming a suspect before having complete evidence, autopsy results, and DNA test results.

“The rules say that following a report, the police must examine witnesses. After that, there has to be letter evidence from autopsy results, post-mortem, and DNA tests. What happened in this case, when the witnesses were not yet complete, they already named the suspect. Meanwhile, the DNA test results were only announced to the family on September 12. The determination of the suspect and the reconstruction preceded the DNA and autopsy results,” Kawer said.

He said the autopsies were even carried out without family consent. During the autopsy process, no family representatives attended the autopsy. He also assessed that the police initially did not plan to announce the results.

“In fact, it is mandatory to notify the family for the autopsy. After the autopsy was conducted on September 1, we asked for the autopsy results but the police resisted giving them. The police said it was confidential. We kept asking but to no avail until yesterday at the victim’s cremation. Upon the insistence of the family, the police read out the autopsy results,” Kawer said.

A family member of one of the victims, Pale Gwijangge, confirmed that the autopsy was conducted without the family’s consent. Gwijangge also doubted that there were only two victims who were shot as many of the victims’ body parts had not been found.

“Most of the body parts are missing, so the autopsy result is only from several parts of the body. We do not accept the results. Especially because during the reenactment of the crime, it revealed that four people were shot,” he said.

Gwijangge said the authority must search for all the missing body parts to confirm whether they were all shot or not. During the reconstruction, it was clear that all four of them were shot. If the bodies of the four victims have not been found intact, we consider the autopsy results invalid,” he said. (*)
